A recent survey found that the majority of B2B organizations (61%) doing email marketing in North America are still not fully compliant with Canadian Anti-Spam Legislation (CASL) and even more are not compliant with a number of other countries that have enforceable opt-in regulations. On July 1, 2017, a very important provision called “Private Right to Action” goes into effect that allows any individual to directly sue another individual or organization for up to CAN$ 10 million for a single violation of the individual’s privacy rights under CASL. Before this, individuals were only allowed to report violations to government authorities. After July 1, a flood of lawsuits including class-action is expected against organizations that are not abiding with CASL fully by that date.
